A training session, sponsored by IS Compliance LLC DOT Consulting Service in collaboration with North American Compliance Services, brought trucking industry participants together on April 23 for DOT audit training and a compliance update at the Pharr Global Business Hub.

The company operates as an outsourced safety and compliance department, providing guidance on registration, recordkeeping, and daily DOT obligations to help carriers remain compliant and operational.

The session was led by former Department of Transportation auditor Juan Jauregui, who provided a detailed overview of how federal audits are conducted and what triggers them. He explained that audits are not random but are initiated through data analysis. Triggers include high violation scores, such as exceeding 65 percent in hours of service or 80 percent in maintenance, as well as complaints, fatal accidents, or a company’s own request to obtain a safety rating.

Jauregui described the preparation process auditors follow, noting they review safety reports to identify specific drivers, vehicles, and violations before conducting an audit. He advised companies to use the same reports to conduct internal reviews. “We have the right to prepare ourselves. Yes, but the rules also say that you must always be prepared for an audit,” he said.

A central focus of the training was documentation. Jauregui emphasized that maintaining complete and current driver qualification files, vehicle maintenance records, and accident reports is essential. He stated that undocumented actions are treated as if they never occurred. “Even if you tell me very nicely that you did it, it doesn’t exist as long as I don’t have it documented,” he said.

The presentation also addressed accident rates as a determining factor in audit outcomes. Jauregui noted that a high accident rate per million miles could result in a conditional safety rating, even if other compliance areas are satisfactory. “Even if you are perfect in all areas, but you have too many accidents, you will come out conditional,” he said.

He also clarified post-accident testing rules, stating that drug and alcohol tests are required only in cases involving a fatality or when the company’s driver is cited for causing the accident. Additionally, he explained that fines are calculated based on a company’s revenue and violation history, which can significantly affect operations. “They are made to affect the operation, depending on the company’s revenue,” he said.

Throughout the session, Jauregui emphasized the importance of proactive compliance, urging companies to maintain readiness at all times rather than reacting after receiving an audit notice.
