Statement by City Attorney’s Office on Guzman lawsuit

The City of McAllen Legal Department was made aware of Mr. Guzman’s lawsuit when contacted by various media outlets on Monday, September 1, 2014 (Labor Day).  Prior to those contacts, the legal department was not aware of any concerns that Mr. Guzman (or anyone else) had regarding the legality or application of its ordinance related to regulation of loud noises and disturbances. Neither Mr. Guzman, nor his representatives, contacted the legal department nor any other members of the City’s senior staff to express any concerns or complaints regarding the ordinance, prior to filing of the lawsuit.

The City of McAllen has a long and positive history of protecting the rights of citizens to express themselves, while ensuring that such activities do not unduly interfere with the rights of other citizens.

 The City will file an appropriate response to the lawsuit.
