EDINBURG, Texas – In an effort to keep the public safe, the Hidalgo County Criminal District Attorney’s Office and local law enforcement are implementing a “No Refusal” week spanning from Friday, March 14, 2025 to Sunday, March 23, 2025. This week takes place during Spring Break, a time when a variety of activities and festivals take place. This holiday can involve excessive alcohol consumption which may lead to impaired judgment.
Law enforcement will be looking for drivers who are impaired by alcohol or other substances. If a person is suspected of driving intoxicated and refuses to provide a breath sample, officers will draft a search warrant allowing local judges to authorize a blood draw from drivers who have demonstrated evidence of their intoxication. The Texas Court of Criminal Appeals has upheld blood search warrants as a legal means to obtain evidence in DWI cases from suspects who are arrested but refuse to take a breath or blood test. Nurses will also be on hand to draw blood once a warrant is obtained.
“As drivers hit the road to celebrate Spring Break week, we want to remind residents that our law enforcement officers will also be on the road looking for impaired drivers,” said Hidalgo County District Attorney Toribio “Terry” Palacios. “Spring Break No Refusal Week is a reminder that if Hidalgo County drivers are intoxicated and get behind the wheel, they will be arrested and charge
