In a significant move to protect the U.S. Constitution, Senator Ted Cruz (R-Texas), alongside a coalition of senators and representatives, filed an amicus brief urging the Supreme Court to intervene in the case Smith & Wesson Brands, Inc. v. Estados Unidos Mexicanos. The case stems from a lawsuit by the Mexican government against U.S. firearms manufacturers, accusing them of responsibility for crimes committed by Mexican cartels. Senator Cruz and his allies argue that this lawsuit undermines American sovereignty and threatens the Second Amendment.

“I am leading this amicus brief to uphold American sovereignty and our Second Amendment,” stated Cruz. “The lawsuit filed by Mexico seeks to trample on our Constitution. I look forward to the Supreme Court ending this madness, putting an end to Mexico’s assault on our Second Amendment, and sending a clear message that any country will not erode American sovereignty.”

The stakes in this case are high. Cruz and his co-signers assert that the Mexican government’s lawsuit represents an unprecedented overreach by a foreign power, attempting to hold U.S. firearm manufacturers liable for crimes committed in another country. Such a move, they argue, not only undermines the sovereignty of the United States but also jeopardizes the Second Amendment rights of Americans by targeting the firearms industry.

Rep. Darrell Issa (R-Calif.), who led the House coalition supporting Cruz’s brief, highlighted the importance of this fight. “This lawsuit has unified our friends and allies almost as never before, including the National Shooting Sports Foundation and the Firearms Regulatory Accountability Coalition,” said Issa. “This is a landmark legal question and weighs whether to allow foreign governments to violate American sovereignty, bankrupt our firearms industry with lawfare, and undermine our Second Amendment rights. Today, we reaffirm our commitment to our constitutional freedoms. Our cause will prevail.”

The case has already traveled through the U.S. legal system, with the United States Court of Appeals for the First Circuit hearing it previously. Cruz has been a leading voice at every stage, rallying senators and representatives to defend constitutional principles. His advocacy includes prior amicus briefs supported by figures such as Sens. Marsha Blackburn (R-Tenn.), John Cornyn (R-Texas), Mike Lee (R-Utah), and dozens of House Republicans.

“This case is not just about firearms manufacturers—it’s about safeguarding our Constitution,” Cruz emphasized. “The Second Amendment guarantees the right to bear arms, and that right cannot be subjected to the whims of foreign governments.”

Critics of the lawsuit warn that a ruling against the firearms manufacturers could set a dangerous precedent, allowing foreign entities to influence U.S. domestic laws and policies. Cruz and his allies see this as a pivotal moment for both the Second Amendment and American sovereignty.

“If Mexico’s lawsuit is allowed to proceed,” Cruz argued, “it will open the door for other nations to exploit our legal system, eroding our constitutional rights and threatening industries vital to our nation’s heritage and security.”

With Cruz leading the charge, the coalition urges the Supreme Court to grant certiorari and decisively rule against the lawsuit. They hope this will signal that the U.S. legal system will not entertain foreign attempts to dictate American policies or undermine constitutional protections.

Cruz remains steadfast as the Supreme Court considers whether to take up the case. “American sovereignty is non-negotiable,” he declared. “The Constitution is not up for debate, and the Second Amendment is a cornerstone of our freedom. The Supreme Court has an opportunity to affirm these principles unequivocally, and I am confident they will do so.”

For Cruz and his allies, this case is about more than firearms—a battle to preserve the foundation of American democracy and constitutional governance.
