McALLEN, Texas – A Hidalgo County judge sentenced a McAllen couple to decades in prison during a sentencing hearing. Evelyn Chavez, 41, and Brian Chavez, 40, of McAllen, were both sentenced to serve 40 years in prison after previously being found guilty by a Hidalgo County jury of Continuous Sexual Abuse of a Child, Indecency with a Child by Contact, and Aggravated Sexual Assault of Child. The guilty verdict was returned on November 20, 2025, while the sentencing by the judge was heard today.
On July 22, 2022, the McAllen Police Department was notified of a sexual assault allegation involving both Evelyn and Brian Chavez with a minor child. Through the investigation, it was revealed that the child had been sexually assaulted by both defendants, at the same time, over the course of several years.
For several days, the jury heard testimony regarding traumatic moments that the victim endured from the ages of 5-8 years-old and the tactics that both defendants utilized to abuse the child and conceal their crimes.
The jury trial was heard by Judge Joe Ramirez in the 464th District Court of Hidalgo County, Texas. Both defendants were tried together. On January, 21, 2026, Judge Ramirez sentenced both Evelyn and Brian Chavez to 40 years on Continuous Sexual Abuse of a Child, 20 years on Indecency with a Child by Contact, and 40 years on Aggravated Sexual Assault of a Child.
“Nothing is more devastating than to hear about the atrocious acts that were committed by these defendants who acted with a depraved indifference to human dignity,” said Hidalgo County District Attorney Toribio “Terry” Palacios. “I hope this sentence ensures that they never have another opportunity to harm an innocent child again.”
The charges are the result of an investigation conducted by the McAllen Police Department, Texas Department of Family and Protective Services, and the Hidalgo and Starr County Children’s Advocacy Center.
Assistant District Attorney of Major & Special Crimes Laura L. Rodriguez and Assistant District Attorney Michelle Beltran prosecuted the case.
